1.3. Tombstone Eyewear is bound by the Australian Privacy Principles (APPs) contained in the Australian Privacy Act 1988 (Act). 1.4. Except where indicated to apply to customers in particular locations or governed by a particular law, each clause of this policy applies to all Tombstone Eyewear customers.

2. Dealing With Tombstone Eyewear

4. How We Collect & Hold Personal Information

When you create an account with Tombstone Eyewear, your details may be added to Tombstone Eyewear's marketing database to receive product related information.

5.4. Your personal information will not be used for such marketing purposes where you have opted out of receiving such communications. You may opt-out of receiving marketing materials by unsubscribing form our marketing database, either by clicking unsubscribe on the email, SMS “STOP” in response to an SMS or emailing Tombstone Eyewear.

5.5. If you provided personal information as part of a job application with Tombstone Eyewear, we will hold, use and disclose that information solely for the purpose of considering your application. If it is necessary for Tombstone Eyewear disclose personal information to third parties to verify the accuracy of that information, we will only disclose such information as is necessary in the circumstances.

5.6. Tombstone Eyewear website may contain content from or links to other websites, platforms or services unaffiliated with Tombstone Eyewear. 6.1. Tombstone Eyewear will not sell, rent or otherwise disclose personal information for profit. Tombstone Eyewear may disclose or receive personal information or documents about you, including to/from:

6.2. In the event that Tombstone Eyewear discloses personal information to a third party, Tombstone Eyewear will take commercially reasonable steps to bind such third parties to appropriate levels of confidentiality but Tombstone Eyewear cannot be responsible for the third party’s failure to comply with its confidentiality requirements.

6.3. Tombstone Eyewear is likely to disclose personal information it collects and holds about you to third parties who are not in Australia (such as third parties located in the United States of America) for one or more the purposes set out in this policy. These jurisdictions may have less protective privacy and data protections laws your jurisdiction.

6.4. Any sensitive information collected will only be used for the primary purpose for which it was collected, a directly related secondary purpose, where you consent or where required to be disclosed by law.

7. Accessing & Correcting Your Personal Information

7.1. If you request in writing to the Privacy Officer, Tombstone Eyewear will, within 45 days, provide access to your personal information that we hold, the sources of such information, the purpose of such information being held and how certain types of information are shared with or sold to third parties, except in certain circumstances set out in:

(a)  the Privacy Act 1988 (Cth) for Australian residents; or as may be relevant to
      your jurisdiction.

7.2. You have the right to direct Tombstone Eyewear to not sell your personal information.

7.3. Tombstone Eyewear will require proof of identity and payment of an administration fee for providing access to your personal information.

7.4. You may also request Tombstone Eyewear to correct your personal information held by Tombstone Eyewear provided that Tombstone Eyewear is satisfied that it is reasonable to ensure that the personal information is accurate, up-to-date, complete, relevant and not misleading, taking into account the purpose for which the personal information is held.

7.5. You have the right to the erasure of personal data concerning you by Tombstone Eyewear, unless:

(a)  for Australian residents, processing is necessary for exercising the right of
      freedom of expression and information, for compliance with a legal
      obligation, for reasons of public interest or for the establishment, exercise or
      defence of legal claims;

7.6. Tombstone Eyewear shall notify any of its own service providers or contractors to delete personal information about the consumer collected, used, processed or retained by the service provider or the contractor unless this proves impossible or involves disproportionate effort.

8. Complaints And Queries

8.1. Tombstone Eyewear has a Privacy Officer to oversee the protection of your personal data. If you have any questions about this privacy policy or are concerned that the way Tombstone Eyewear collects, holds, uses or discloses your personal information may be in breach of the APPs or any other privacy law, please send the details of your complaint or request by email, addressed to:

8.2. Such query, complaint or request must provide sufficient information to verify your identity and provide sufficient details for Tombstone Eyewear to understand and respond.

8.3. You can only make 2 requests for access or data portability in any 12 month period. For data portability requests, we shall endeavour to provide your personal information in a readily useable form.

8.4. After receiving a complaint, Tombstone Eyewear will consider whether further information is required from you to properly consider and investigate the complaint, and may request such information from you. Tombstone Eyewear will then conduct internal discussions with the relevant business units involved in the collection, holding, use or disclosure of your personal information and evaluate whether we believe there was a breach of relevant privacy laws and notify you of the result within 45 days. We may inform you that we require up to an additional 90 days in some circumstances.

8.5. If the conclusion of our investigation is that our collection, holding, use or disclosure of your personal information was in breach of any privacy laws, we will take steps to remedy the breach as soon as reasonably practicable.
